Salary Cap Witch Hunt. **Appeal unsuccessful**

Toddy should change it to salary crap as he has turned this to **** as well.

The thoroughbreds must not get any benefits at all according to Toddy from the club or clubs owners/employees.

Greenberg is the best CEO the AFL have ever had.
Agent Todd of the AFL.

Big day for anti Manly sentiment on social media.

I had a world record ( for me) day yesterday with over 250 likes, mentions and retweets.

I’m lucky if I get 10 a week usually!

Today, I’m at home making Rock Cakes and Scones ( weather not conducive to fishing).

**** them all really , going off half cocked and that includes most of the journo’s who don’t do any research just plagiarise someone else’s work and have no ****ing idea.

Mob of pricks the lot of them!
Rock cakes taste better than fish...

Ch9 running a beatup on Bozo with "leaked" documents to show the NRL trying to contact him multiple times to arrange to meet.

I wonder who leaked them ?

NRL360 reporting that Manly used 'best endeavours' whereas the NRL redefines that term as 'guarantee' @

"DEFINITION of 'Best Endeavors' A term commonly found in commercial contracts, that places upon the party given such an undertaking, the obligation to use all efforts necessary to fulfill it. "Best endeavors" places a party under a stricter obligation than "reasonable endeavors."

It's the grey area of tpa's which is why they are so dodgy. An example of the Manly situation was that Manly said to the player we have a 500k contract but we know you want 600k and we will do our best endeavour to get you the extra 100k you want (thru tpa's).

Easiest way to stop cap rotting is to scrap the tpa's all together. That way everyone's contract needs to be included in the cap

Kent also quoted Greenturd's comment about the '800,000 examined items, the most thorough investigation ever undertaken by the NRL...'

Then he showed the 2v interview where 2v says no one interviewed him.
Even though he was the head coach for the initial 3 years of the breach 😕

So essentially this whole mess comes down to the fact that there is no 100% definition of what is ‘at arms length’ when looking at third party arrangements.

Manly feel they haven’t had a direct involvement in setting these up, whilst the NRL obviously do. What a mess.

All that would need is a 21st century Terry Hill to take it to court for 'restriction of trade' earnings @

If that’s the case then isn’t the best way to manage this by having the deal and if the club is guaranteeing it, attach an unconditional undertaking from the club to the player that the player can call on if they don’t get paid? It’s attached to the contract when it’s submitted. Problem solved.

Have just been through about an hours worth of reading anti-Manly posts on Facebook. Damn, my brain hurts lol. There are actually some idiots out there who think we should hand DCE over to the Titans and that Walker should be forced to go back to Souffs.....because we obviously retained/got them illegally and are still benefiting from it.

Rothtool has a lot to answer for after last nights rant, as does whoever leaked their names to him since the NRL has already said that the 13 players in question won't be named.

And there are even delusionals who think that Greenturd is protecting us because we're one of his favoured clubs. HA!!!!! He's the one who's been leading the mob with pitchforks and torches wanting Sea Eagle blood.

If by some of his comments yesterday Greenturd wanted to instill [even more] hatred of Manly throughout the rugby league world as some sort of compensation for the league not finding evidence that we actually cheated.....then it worked.

Why can't we just have a normal season

He just wanted a nice, normal Christmas.....

you cant do that though can you? Isn't it illegal to cap somebody's income?

Huh, It's against NRL Cap rules to guarantee.
Hence our current predicament. 😕

Kent was just highlighting why Manly believe that they did not legally guarantee, whilst the NRL equate the two legal terms - incorrectly 😎

Best Endeavours =/= Guarantee in contract law

Settle on the meaning and if it means guarantee it’s pretty easy to manage. Do the same as the construction industry.

Have to give Zorba credit where it's due..stick those sausage rolls up the NRL

Manly's salary cap saga: A Sea Eagles insider answers the hard questions
  • here’s how we covered the original story. And then there was the report that neither Daly Cherry-Evans nor Dylan Walker’s contracts are salary cap-compliant. And then reports that Darcy Lussick will be heading to Super League. And then, finally, Trent Barrett saying the saga will take years to recover from. Read all of it. Educate yourself.

No, no wait: we forgot about Manly’s sponsor Lottoland being banned from operating in Australia.

HOW MUCH HAVE THE SEA EAGLES COOPERATED WITH THE SALARY CAP INVESTIGATION?
ZORBA: To say our club hasn’t cooperated is wrong. The integrity unit came in, staff members gave up their telephones – I gave mine up -, our laptops were given up and our records were given.

800,000 emails and whatever else has gone on, but they haven’t interviewed the main person who has done all the recruiting in Manly’s rebuild: Bob Fulton.

WHY WASN'T BOB FULTON MADE AVAILABLE TO THE INTEGRITY UNIT?
ZORBA: To think that an Immortal in Bob Fulton has had his good named dragged through the media like it was on Monday in an unsavoury manner, to say that he has not been made available to the integrity unit is wrong. He’s been my mate for forty years – or longer – and I know his word is his bond.

It’s tarnished one of the four original Immortals. He was given no indication that his name would be dragged out like it was Monday at the press conference. The CEO of the League, Todd Greenberg, spoke to Bob before that meeting. Bob was available – but only on a face-to-face level. He was away in Hawaii, he was away in Port Dougles with his wife Anne, who he has looked after since 2000 when she was diagnosed with a serious illness. That’s the main priority in his life.

He’s not one for dodging any issues. He wanted a face-to-face interview, not one on Skype, not over the telephone. I’ve seen text messages that say, ‘I am happy to meet you face-to-face’.

HOW MANY TIMES DID THE NRL CHASE BOB FULTON?
    To my knowledge, three.

HOW CAN THE CLUB EXPLAIN DCE BEING PAID $400,000 OUTSIDE THE SALARY CAP?
ZORBA: I can’t explain it because I would have nothing to do with such a signing but that story on the back page of The Daily Telegraph also says that the CEO at the time, Joe Kelly, refused to sign that contract and threatened to resign.

Well, he stayed at the club for 18 months after it so he couldn’t have felt too strongly about it.

That’s a leak from the Roosters to Phil Rothfield

ACCORDING TO THE NRL, MANLY MADE ‘DELIBERATE BREACHES OF THE CAP’
ZORBA: Manly have indicated they may contest those findings and, if they appeal, it’s then the NRL’s word against Manly’s. If they feel strongly enough to go to an appeal then that’s their right. Maybe they could go to a legal procedure where it's heard rather than go the head body who now have to decide whether or not Manly will appeal.

$1.5 MILLION OUTSIDE THE CAP OVER FIVE YEARS IS A LOT OF MONEY
ZORBA: It’s not when you look at clubs being $100-200,000 over, almost annually.

BULLDOG RITCHIE: You can't condone it.

    Z: It’s $300,000 a year

BR: It’s still over the cap, though

Z: I think the interpretation of third parties is under the spotlight more than that. I don’t think the club has gone out and deliberately cheated. I know my club well enough to know and the people involved – I don’t think – would do that.

SCOTT PENN SAID THE SEA EAGLES ARE NOT CHEATS AND ARE BEING HUNG OUT TO DRY
ZORBA: I don’t think I’m the right person to ask: he’s my chairman, he’s also my nephew. I’m obviously going to support Scott because I believe that’s an honest young man and a fine young businessman.

The Penn family lose over a million dollars a year supporting this club.

ARE THE SEA EAGLES BULLISH, DEFIANT OR EMBARASSED?
ZORBA: We’re constructively defiant and we’re not going to have our image tarnished any more without putting up what we think is a constructive answer to the allegations that have been made.

Let’s not forget, this club has been dragged through the mud with match-fixing. A massive police inquiry found absolutely nothing. As a result of that inquiry, some things were said to the League and then the League conducted an inquiry into the salary cap.

Every year for the last five years, annual reports on the salary cap are given and we’ve been ticked off as one of the best clubs.

DO OTHER CLUBS HAVE THE RIGHT TO BE ANGRY AT MANLY?
ZORBA: I can’t comment on that.

WHY WERE NEIL BARE AND JOE KELLY KICKED OUT OF THE GAME?
ZORBA: I can’t comment on that either.

    HAVE MANLY GOT OFF LIGHTLY?
ZORBA: I don’t think we’ve got off lightly with what’s happened to us over the past couple of years with match-fixigng, salary cap…alleged rorting. No, we haven’t got off lightly.

WHAT’S THE DIFFERENCE BETWEEN PARRAMATTA OR MELBOURNE AND MANLY?
ZORBA: We’re salary cap compliant at the moment. They weren’t at the equivalent time. I don’t think comparing what we’ve alleged to have done compared to what Melbourne and Parramatta did is like somebody being – in Manly’s case – alleged to have stolen a Paddle Pop where the others have stolen the Crown jewels.

Quite a contradiction there wouldn’t you agree?
