Salary Cap Witch Hunt. **Appeal unsuccessful**

Greenberg almost baited us to appeal by the strong language he used. It is no longer a question of the penalty. The reputations of Penn (a respected businessman) and Fulton (an immortal) and others - as well as the reputation of our great club - have been smeared. If they are innocent as they say they are they should and will fight to clear their name imo. The statements Penn and Fulton made late yesterday suggest that's exactly what they intend to do.
 
Based on what I know outside of the cap stuff which is all public knowledge, Joe Kelly isn't the most astute businessman (CoCo Joy anyone?) and did a terrible-poor job as CEO in his time here, and Bozo among other things mercilessly sacked Toovey, ran another CEO out of town and gave numerous jobs to his own family - so if you're asking me if those two may have been involved in something untoward, then I'd be leaning towards yes - most likely lead by Bozo who as we all know was the pseudo leader of this place.

And my broader point still stands. Look at Cronulla with the peptides. Did Flanagan ever admit guilt? No but they took the penalty (which was admittedly pathetic) and moved on and even won the comp the following year. 330K a year off the cap isn't that much, especially in light of the dead weight they've carried in years past. It's ultimately a question of fight this and have it lingering for possibly years along with the drag on our reputation, etc. or draw a line in the sand and move on? Other league fans will assume your guilty even if we win every legal challenge so there is nothing to be gained in public opinion. Right or wrong in this situation is of no consequence - It's purely a matter of whether you want this to end or continue.
If what Penn has stated publicly, ie that the club has not paid one cent to any player that wasn't 100% disclosed to the NRL then to not fight this would be p1ss weak. The TPA rules allow for a club to offer their "best endeavors" to make introductions and it seems that is precisely what has happened here.

All of this seems to have started with a disgruntled ex player making statements during an investigation into match fixing accusations which came to nought.

This whole thing stinks to high heaven and if I was Penn I would fight all the way to the highest court in the land.

It seems amazing that the nrl are trying to say that clubs need to report any conversation ever regarding tpa's in their cap.

They are delusional if they think every club has done that. They would need an office the size of Tasmania to hold all the paperwork.

So if "Bob's Garage" wants to tpa a player.... obviously they are going to ring the club. The club passes that on to a player manager and hears no more about it but somehow they are supposed to report the amount to the nrl or even if it went ahead?

How would they know that? I must have interpreted it wrong as if Todd has fined Manly because of that, surely even first year lawyers would be lining up to take that on.

Persecution, pure and simple.
One could even say a witch-hunt?
 
I like the tone of what Penn said in the article it sounds like he believes we have done nothing and I hope he pursues it
We can’t get fined or penalised anymore cane we?
I also hope Fulton goes for Greenturd s throat after he and NRL have smeared him.
When you look at the team the Roosters wheeled out on Sunday night and think about who they r adding next year as well then look at us its just laughable
 
I remember parramatta made a big song and dance about appealing, they were as guilty as sin.
I don't know enough to make my mind yet. I hope they do appeal so the NRL 115 page report will become public knowledge

I doubt it. TPA's and much of the NRL rules fall outside the jurisdiction of a court. The only action Manly could really take would be civil and that cost would likely be higher than the fine and the risk of losing to high.

I would think the most likely would be a drawn out process whereby Manly continue to ask for extensions as well as delay the tactic and continue to respond to each of the points delaying a final decision very likely into late 2019, Manly simply registering their disagreement but still paying the fine

I hope it finishes up in Court and I hope the disgruntled former player behind all of this is forced on to the stand to tell the truth and be exposed to proper cross examination.
 
Many of us are saying that Penn should challenge the decision. It is ok to say this if it not your money being spent. The longer it goes, the more it will cost him in legal fees. I guess it all depends on his legal advice. If it is a 50/50 shot, he really shouldn't bother. If his legal team are more than confident, than yes. But can you really trust a lawyer? They will be the only ones making money out of all this.

Penns have lawyers on staff.

Their win against CoCo and Snake's win against the media coverage of the Match Fixing, shows that the rule of law still counts for something 🙂

Greenturd's media conference attack on Bozo's reputation was a misstep by the NRL.😎

Buzz openly stating that Penn commited fraud is also defamation. 😎

NRL's rules are theirs to uphold, but they can not publicly infer that people are therefore corrupt :shake:

The good thing is that Manly know the worst case scenario and can directly address each explicit point of the NRL findings 🙂

Correct me if I am wrong but has the NRL actually laid out their case to what the club has done? Step by step?
