Salary Cap Witch Hunt. **Appeal unsuccessful**

Sounds like Manly will fight this hard...

NRL accused of conflict of interest over Manly Sea Eagles salary cap probe, deny steering Mitchell Pearce clear of club

Andrew Webster

The NRL has admitted it hired a forensic accountancy firm linked to commissioner Tony McGrath to investigate alleged salary cap breaches at Manly and Parramatta, raising serious questions about a conflict of interest.

As tension between the NRL and the Sea Eagles intensifies over the way the investigation has been handled, head office has also denied former Roosters halfback Mitchell Pearce was "tipped up" about the impending breach notices, persuading him to steer clear of Manly and instead sign with Newcastle.

This is going to get VERY MESSY!!

Only issue I see is if the club has in turn given her benefits of some description, this is a problem.

She is not a sponsor. She is a TPA. TPA's cannot benefit at all from the club. They have their arranged agreement with a player and that is all.

Perhaps there is evidence of the club doing something for this lady and that is why it is being scrutinised....?

I could certainly confirm that for any of the MWTS trips she attended SHE PAID!!

So the Commission hire a commissioners company to investigate Parra and us and don't think that's a conflict of interest.

They need to be investigated. This has gone beyond ridiculous. Their using the NRL's money to fund the own pockets. Wtf.

Who is capable of stopping these guys... Clearly they think they are above the law.
Enough is enough , i can not take this any more , Let "s storm the barricades / Who 's with me ? Gee looking around now i think that i will just make this a trial run .

So Tony McGrath enlists the firm he was(/is?) a partner in, KPMG, to investigate Manly. Wonder how much NRL money was wasted and who got pieces of it.

This stinks.

Knowing the NRL Mark, someone from the club probably gave her a scarf on a cold night and that's enough for the NRL to wage a war with the Sea Eagles...

She probably got invited into the sheds, big deal, what’s the monetary value in that?

I would hope the club pushes back as hard as they can. If there is anything real in the suggestion there is an agenda against Manly at the NRL then accepting what the NRL dishes out is asking for trouble.

Obviously we only want to work on the facts we have but if we meekly submit it sends a very wrong message.

And the bronco,s keep signing players.. the addition of Tagataese only boosts their pack. Its like they are throwing it in our faces. The NRL has become a joke. The blatant favouritism to some clubs is so arrogant and obvious. I might be paranoid but it seems they are doing their best to wreck our great club. What better way to reduce Sydney clubs
And we will miss out on any of the $30m being handed out to NRL clubs by the govt to set up centres of excellence Roosters souths dogs etc will gain the money

Not satisfied with outrageous stadiums largesse, now NSW Government wants to offer $40m to NRL clubs

Hold on to your hats, sports fans, this is getting more outrageous by the day. You will be aware, I know, that there is an issue at the moment over whether or not it is a good idea for the State Government to go through with its plans to knock over three relatively new Stadiums – at Parramatta, Homebush and Moore Park – and rebuild them at a cost of $2.5 billion.

The pro-bulldozer mob have on their side all of Alan Jones, the wider SCG Trust, Venues NSW, most of News Limited and most importantly the controlling half of the NSW Government. The other half think, to use the words of one: "It's the dumbest f--king idea I've ever heard. It screams largesse and the public won't buy it.

And while I have respectfully asked Premier Gladys Berejiklian three times now, to justify her claim that the $2 billion outlay will be made back in two years, as yet there is only radio silence ... and the rather unpleasant guffawing of economists who point out that with that kind of a return, private equity would be rushing to finance it, and there would be no need to call on the public purse. And even the government's own figures do them down, as originally revealed by my colleague Jacob Saulwick, concerning the insanity of the SFS project alone, which noted the advice of Infrastructure NSW that there would be "no economic benefit to the state of NSW ..."

But still, we have not come to the most stunning development of the last two days. For in the middle of all this – which has included Sydney City Council, followed by Randwick and Waverly Council, passing strong motions against the stadium rebuild – we have it on the authority of Channel Nine's state political reporter, Chris O'Keefe, that the NSW Government is about to make another announcement concerning their sporting largesse, concerning an allocation of $40 million to sport.

Who to?

Well, specifically, that $40 million is going to NRL clubs, to refurbish their gyms, and expand their facilities!

O'Keefe reports that the $40 million is "expected to be handed over to six clubs ... to help clubs build 'Centres of Excellence' . . . It is expected South Sydney will be handed money to build at Heffron Park in Maroubra, Canterbury Bulldogs at Belmore, Sydney Roosters at Moore Park, Cronulla at Shark Park and Newcastle Knights at Hunter Stadium."

The N R L has already called in Tony McGrath "s forensic accountancy firm to investigate .

The only way we can become a stronger club is to accept responsibility and take ownership from our mistakes and learn from the sht we created .
Depends who you believe. The SMH has now been leaked detailed information (presumably by our side in self defence) and the breaches sound very weak. But none of us have seen the evidence.

Greenburg: "Brenda, what did Kieran Foran do for you that warranted 3rd party sponsorship"
Brenda: "Well Todd, 1st there was the baby oil, and his soft suple hands...ooooh so soooft..."
Brenda again: "But you Todd, I wouldn't go there, not even with Gavin Miller's nose"
Greenburg: " OoOoOOooooh, cmoooooorn"

Six clubs eh. Some forensic reporting right there

I so want Brenda to sponsor Todd carney now (and us to sign him), and for the deal to hit Greenburgs desk. Poor bloke would probably choke on his muffin. Oh, and Manly signs him for 100k or something !

Would - be - interestiiiiiiing.

Car deals at the centre of Manly Sea Eagles salary cap investigation

Cars provided to players by Brookvale Mazda formed a crucial plank in the NRL's salary cap investigations as a legal stoush looms over what constitutes an "arm's length" third-party arrangement.

Fairfax Media can reveal that the car deals and player sponsorships from long-time lawyer Brenda Duchen to Sea Eagles players are among the arrangements under the microscope. Those deals have previously been registered by the NRL and there is no suggestion that the sponsors or players have acted inappropriately in securing them

The NRL is scrutinising deals done during the past five years, a period in which Brookvale Mazda has entered into third-party deals with almost a dozen players.

Tom and Jake Trbojevic, as well as Darcy Lussick and Curtis Sironen, are listed on the car dealer's website as ambassadors. Other players to have been provided cars as part of a sponsorship in recent years include Daly Cherry-Evans, Kieran Foran, Marty Taupau, Brenton Lawrence, Tom Symonds, Jessie Sene-Lefao and Jamie Buhrer.

Some of those deals have piqued the interest of Rugby League Central and the club is now tasked with explaining the nature of the relationships that led to them in some cases.

Mazda Brookvale owner Joe Rinaldi said he was unaware his company was named in the breach notice and believed all deals had been in line with NRL regulations.

"It would probably be about 10 to 12 players [we've sponsored] since about 2013," Rinaldi said.

Asked how the deals were brokered, Rinaldi said: "Through the agents, or I've actually gone to see them play. I've sourced them myself in some cases. They are locals. [I've aligned the business because] the northern beaches is very insulated and they play for the local club."

Duchen has been involved in the sponsorship of just three players, understood to be Foran, Dylan Walker and Matt Parcell. The TPAs have been for relatively small amounts, believed to amount to about $50,000 a year on average. The contracts have previously been rubberstamped by the NRL, but the governing body is casting another eye over whether Manly guaranteed them.

Duchen declined to comment.

Another area of contention between club and head office relates to deals for Foran. At one point, Foran instructed lawyers to pursue about $150,000 he claimed was owed to him after he defected to arch-rivals Parramatta. It is understood the contention arose over whether the amount was categorised as a third-party arrangement or a marquee player allowance. Ultimately, Foran dropped the matter and it was deemed an MPA, although the NRL may now form a different view following its probe into alleged salary cap breaches at the club.

It is understood the NRL was unable to trace any illegal payments. However, after trawling through thousands of emails and text messages, the governing body will allege that some of the supposed introductions made should be counted against the cap, even when deals ultimately weren't done. The NRL will allege that players were taken off the open market over alleged TPA "promises", whether they were fulfilled or otherwise.

The outcome of the Manly saga will have huge ramifications for the code, as the controversial TPA system comes under fire for its ability to be manipulated. There is also the issue of inequality, with the payments working against the salary cap's objective of creating a level playing field across the 16 clubs.

The drama is expected to stretch into the off season as Manly takes the time required to respond to the notices.

Absolutely ridiculous. The NRL is throwing stones at a very large glass house of their own construction.

"should be counted against the cap, even when deals ultimately weren't done."

So now we're getting done for deals that weren't done... That'll do me. Wtf is going on. It's like the Twilight zone.

Our club is being scrutinised like no other, not seen in the history of the game.

"players were taken off the open market over alleged TPA "promises", whether they were fulfilled or otherwise."

What about Hayne being taken off the open market when the NRL created an imaginary market value when he didn't even go to market!?!?!

Or what about Parra or the Storm assembling a roster far greater than any other while cheating the cap and then having the ability to pick and choose which players they can let go...

This just stinks. It really stinks. I just hope the Penns have the ability to get a fair go. Doubt it. NRL is going to go full throttle at them to protect the truth.
We should start a go fund me page or something to help...
The Penns are smart men, wealthy enough to own an elite sports club. They would definitely have access to the best legal representation money can buy. The fact they have requested an extension in giving their response suggests they are preparing to go to war. What first started as an NRL funded attack on our club, may well, in the end, turn out to be the best thing that has happened in the game since the Super League war ended. There’d be a few nervous nights to be had by some over at League HQ. That’s for sure. Those responsible for fanning the flames of this witch hunt, have done so expecting to remain protected by the fact that unless you support Manly, we are generally hated. But maybe, just maybe, the little guys are going to fight back. Certainly there has been some journalism over the last few days that appears to be heading in that direction. Fingers crossed. Seeing Greenberg clear out his desk would be akin to a premiership for me.

Repying to Tookey's post from yesterday at 11:25

Firstly thanks Tookey for another great post your information is accurate as far as I can see.

I haven't been a member of the Silvertails for long and I am staggered now at all the information that I've read here which does lead me to believe that the NRL really are trying to cut the Sea Eagles out of the Competition to cut the number of Sydney clubs down.

And with the Breach Notice against us, the $40 million on offer to other NRL clubs that we won't see any o, even dragging Brenda into this mess is pulling my chain big time.

If the NRL think this will break our club they are mistaken, Sea Eagle fans are thick skinned and we will pull through this I've got no doubt about that.

This will only make us stronger, if you type in " Manly Sea Eagles plan to partner New York Rugby league team " into google you will see that even with all this Bull**** going on the Club are looking at going into partnership with the NEW YORK Rugby league franchise that's applying for the English super league.

So as a club we are not only standing up for ourselves but are looking at other avenue's to potentially expand by buying into another club even if it is a super league team starting in the second tier.

It's a step in the right direction what do you think?
