Salary Cap Witch Hunt. **Appeal unsuccessful**

You see Greenburgs comment is self contradictory. The only thing the manager and player look at is the magic number regardless of how it’s constructed. It defies common sense and logic to even suggest the amount of TPAs will not bit play a part in the players decision. I can’t brlueve he was stupid enough to have said that!
 
The game is currently undergoing a case study in the prosecution of the latter. Manly was pinged for illegally paying players $1.5 million over five years. The club, in its defence before the appeals tribunal, has taken a very technical approach. It boils down to the eternal question: What exactly constitutes an arm’s-length arrangement? While the NRL’s decision is expected to be upheld, it is an issue that has been vexing former High Court Justice Ian Callinan QC for several months.

Even some of the men negotiating TPAs – there are five different types of them – privately admit they are not au fait with exactly how the rules work.

“I think TPAs have an ability for some of our marquee players to earn additional incomes outside their contracts and I support that,” Greenberg said.

“In fact, I encourage that where players use the ability of their own brand and their profile in the game to earn extra income. That is a good thing.

“What I don’t want is it used as leverage in a negotiation with a player and a club. That negotiation with the club should be wholly and solely about the fee he is paid inside his salary cap.”


And Greenberg thinks that some of the wealthier clubs have not been secretly arranging TPAs to bring players to their club. The man is either a liar or extremely naïve. What a load of bull excrement. If he actually believes that supporters accept that is what is happening, he is living in Disneyland.
 
I still maintain that there is no way in hell that the Chooks can have the squad that they are likely to have next year and still be cap compliant.

I mean, just take a look at their likely starting 13, and then remember that they have to fit in another 17 players. And remember that 3 of that 13 (Tedesco, Cronk and Crichton) are all on $1M per year.

Tedesco, Tupou, Mitchell, B. Morris, Hall, Keary, Cronk, JWH, Friend, Napa, Cordner, Crichton, Radley.

That lot alone would just about take up the whole $9.4M cap....and they can still fit in another 17 players? What, have they got players paying them to be there like some low budget Formula One team taking drivers with more money than talent?

Of that 13, only 2 players - Keary and Radley - have not played Origin or Test football....or both.

There needs to be a cap on TPA's because its getting beyond a joke.

Of course they are compliant.

We know for a fact that less than $500K of Cronks money is actual cap, that one is common knowledge it was talked about on national TV 2 weeks ago..

No reason to think Tedesco would be any different.

Why would they need to cheat when they can get away with the rort that is allowed.

I obviously haven't had the time to watch non manly games too much this year. What does Radley do that would warrant soo selection other than playing for the roosters. A little guy who is a good defender? Bench spot - I think peachy has that sown up. Jack bird might get fit. Enlighten me.

He does it's called the NRL , turd style.
 
Possible solution for TPAs: Nothing to do with clubs or the NRL. Cannot be negotiated by player agents but must have a separate entertainment agent for any 'promotional' work. Those contracts are sent to the NRL independently.
I think it would work because, let's face it, the vast majority of players would attract very little interest from any company not related to footy.

Majority of TPAs are the use of cars from a local dealership or wearing sporting apparel.

Manly's issues arose when Brookvale Mazda became a Sponsor whilst having their cars with our players from earlier TPAs 😕
 
I'm no lawyer, but where does the 'berg get off saying it is not on the scale of Manly, when a) Manly's appeal has not been concluded and b) Cronulla's initial investigation has not yet been done. When we apparently got done, he said the investigation was exhaustive and no stone was left un-turned, yet it is taking them months to finalise our appeal. This is amateur hour at its best !!!

The only logical thing to say after that is that’s why Penrith are being investigated by the “Integrity Unit” (I still laugh every time I hear that name) after Maloney revealed that a Keno TPA was part of his Penrith package, and was part of Moylan’s package previously (and presumably not declared to the NRL). This type of blatant cheating surely will not be tolerated by an organisation that upholds the principles of fairness and justice like the NRL.

If the question of tpa's is vexing a QC for several months, and the people negotiating TPA's don't fully understand their complexity; then it's a total farce to rule that Manly is guilty of breaking the rules that no one can understand. Remember; the nrl signed off on everything until greenburg wanted some revenge on Manly, and no player has been paid any more than what was reported.

If this QC can't work out the tpa rules (and he hasn't done so in a timely manner), then he should just rule "Manly are not guilty. Their deals were nrl approved, no players have received any secret payouts, and moving forward... let's sort these tpa rules out."

$100,000 - Motor Vehicle Allowance – a maximum amount of five motor vehicles may be provided to players in the Top 30 outside of the salary cap. (Valued at $20,000 each).

That's a great point. If you need a qc to work it out then it makes every decision made by the NRL who rubber stamps all these TPAS @ every club even more laughable. What a farking joke.

Is that how it’s actually written? If so, you can see why we have confusion:

Is EACH player in the top 30 entitled to 5 car allowances of $20k each? Seems an odd outcome, but the way it’s written it could be interpreted like that.

Are the cars worth $20k or is the car allowance worth $20k?

Who values them? The dealer principal of City Ford? The NRL (who thinks you can rent an apartment in Parra for $100/week)?

The system is clearly broken Todd. The only question is why won’t you fix it? It is because you are:
1. Stupid and can’t see it?
2. Corrupt and want it to stay broken?
