Kent said that the dispute is the NRL claim 'Best Endevours' constitutes a guarantee.
Manly claim that every contract has the same clause and they are not sanctioned as 'guarantors'

Kent also said that the NRL didn't supply their detailed findings to the Media/Fans. 'All they want is to go hard against Manly. Manly are adamant that they did not cheat. But no one has the info to judge either sides claims due to this lack of transparency'

Sounds pretty much like an agenda doesn't it.
Manly should go higher than the NRL. Greenberg law isn't really the law.
 
I have a question.
It's probably been answered somewhere in the many pages on this thread but I've missed it.
This appeal of ours against the decision.
And the hearing.
Are they legal?
I know it's not a court of law but surely, to me, that is where something of this importance should be fought out.
Not, what was already an NRL kangaroo court.

The NRL's interpretation of "best endeavours" is irrelevant in an impartial tribunal.

If every contract we made has the clause that we are not sanctioned as 'guarantors', surely that is stronger evidence than "we interpret".

"We are not sanctioned as 'guarantors'" on paper means exactly the opposite of what the NRL verbalises.and has to carry more weight than yak yak.

Imagine how I feel getting this c$#p, I deal with this on a daily basis with a number of NRL Club Directors on a different level, I could tell more but that will cause more problems. So at the end of the day, hearing my S#@t, how complex is this ****? The fact the NRL still want to stand on their high and mighty attitude, that is really a crock of ****e, is that not a problem in itself. At the end of the day I share this info on the basis of 60% of my fellow Silvertails will take it on face value and the rest well have a F%$k you attitude, I feel most is given in good faith. Some will say I'm full of sh#t, so be it! Some feedback is better than none! BTW Kent isn't really a DH! weirdly his conversations are logical. BTW he knows what I know because he was at the same lunch.

I'm one of the 60% brother. Even if some of your info doesn't eventuate for some reason, I'd rather listen to that than some of the ****e that comes out of the mouths of these journo vultures .

If and when the NRL stick with their original finding against us can it then be challenged in a court of law?
Regardless of whether we can or would, I'm just trying to gauge how much of their bs, ad hoc decisions would collapse in the legal world.
As I understand it, this is not a court.

At end of day it gets to where the club owners want to take it, at best the NRL stance is questionable, the other CEO's are happy with us to run with it. Our expense - their win.

I would love to see us take them on.
I know it would cost a bomb but I think it's necessary.
Necessary to our brand and integrity.

The only problem here is that the NRL and integrity may not mix in the same sentence. If they have an a agenda and there is no balanced legal counter accountability then there is no fairness, and that is where we are really?

No they don't have any of those things but I would like to think that legally, out in the world, they would have to prove themselves.
I personally think it would be a comedy.
Albeit an expensive one.
I think their survival is as perilous as ours on the big stage of major sports.
 
Then they can pay the $330,000 to Manly as compensation, without it being added to the salary cap. Manly should be given it in some way because if found not guilty, the NRL has withheld legitimately earned monies from the club, that is not there's to retain

$330k plus interest and costs
