Salary Cap Witch Hunt. **Appeal unsuccessful**

Have I missed something or has the NRL STILL not given its judgement. I thought Greenberg was giving a decision a few days ago...and then silence.

I reckon the media think are expecting Penn and the Manly Management to get a smack. Hence the timing of the Darcy article. A taste of things to come

While everyone is thinking about conspiracy theories, here's mine.

If the NRL were going to say, too bad, punishment stands, case closed, it would be done.

If they are re-jigging the punishment, looking at fair, equitable ways to set an example, and be lenient, it would take extra time to construct a strategy.

Therefore, I personally think this may end in our favor.

We haven't even been granted an appeal yet have we? Hasn't this whole period been about the appeals committee deciding if our case is worthy of appeal?
They may be just crossing their t's and dotting their i's before they knock back our appeal?....

Yes this isn’t the actual appeal it’s just granting the leave TO appeal!

This isn’t over by a very long shot!

I believe Gorman had spent 3 days in the last week of June pitching our case to the committee. Seems like they agreed to hear the appeal but are now just deciding on the verdict.

I like the optimism but I gave this a funny rating only because it is completely laughable that Turdburgler and his cast of clowns could possibly give Manly any leniency.

Is there any link or story you know of confirming that we had already been granted the appeal? I can't see anything.

You'd think the media would be all over it.

Gorman was probably just confirming things for the appeals application... Not the actually appeal.

Not on the appeal being granted but I don't think he'd be spending two days at the NRL headquarters arguing the right to appeal about 2 months after it was lodged.

Also there were posts on this forum indicating that we'd hear the result of the request to appeal last Tuesday after which we'd likely hold the appeal itself.

I had heard that if we were granted the right to appeal then it would have occurred on the same day. Therefore i would assume no news is not bad news. If we didn't get granted an appeal then they (the nrl) would have immediately said punishment stands. If the appeal went badly they would have also said punishment stands.

I tend to think toddy and his spin doctors are trying to figure out how to remove the punishment or change it without appearing like they are impotent or stupid. So in other words trying to hide the truth!

I heard that they were granted leave to appeal, and Manly were given the option to commence the appeal immediately, so they started it after a short adjournment, hence the 3 days of debate?

The NRL has to at least appear to be taking serious and considered thought in their decision. I bet to end it they offer a compromise, provided the NRL get the credit for it - media story will be "we have decided to reduce the fines as the club has presented enough evidence that the errors in their salary cap was not from potential fraud but a genuine mistake in accounting methods required to remain under the salary cap. Manly have agreed to be more transparent, and have accepted that the methods used was flawed and will strive (under the scrutiny of the NRL's salary cap team) to do better to maintain the integrity of the NRL as a whole"

Wonder how close I'll be?.:lipssealed:

.... So there have probably been some meetings to agree on the wording post decision so everyone saves a bit of face.

Manly are possibly hoping that the Judge says something like: We agree Manly have declared all payments to players but there has been technical breaches of the process which can't be ignored.

The Nrl then hope Manly will respond with something like: We thank the review panel for agreeing with our declaration that we haven't overpaid players. We accept their findings that our technical breach wasn't deliberate. We also accept our role in this matter and have pledged to do better.
It is now our intention to put this matter behind us and work towards re-building a stronger Manly team.

Methinks we are thinking along the same lines!
