Unfortunately it doesn't work that way. The players are counted under the cap as a contract was registered with the NRL for those players for the 2017 season. The NRL will want to be satisfied that the injuries are new injuries that will not allow them to see out their contracts, not pre-existing injuries that were present when they signed their current contracts.
I agree it is stupid, if they genuinely can't play, then they can't play and should not count under the cap. It isn't like we want cap relief for this year and they will play with us again in 2018.
