Salary Cap Witch Hunt. **Appeal unsuccessful**

If you paid for premium membership and are still seeing ads please let me know and the email you used against PayPal and I cam manually verify and upgrade your account.
If its taken by Manly to a civil court, and they have that right, the NRL are required to show their actions have been equitable and their decisions are legally defensible. Its like in any business. A union for example can take a company to the Industrial Court in challenging rules that are considered unjust. I know this is the case because I have represented a union against a state government department, and won. It can happen.

Mate, I have NO DOUBT whatsoever that Manly would win a civil case.

From memory I think the NRL change it's contract to include (and these are in my words, not theirs in any shape);

Not putting the game into disrepute; not to damage the code of the NRL; all decisions by the NRL are binding and can't be challenged in court - all in fear of having your licence torn up / or taken back

So basically if the NRL screw it up, your fried.
 
Most people are happy to criticize Barrett for his obvious coaching flaws.

I don't see too many having a crack over his complaints re: promised staffing.
Nothing different to what previous manly coaches have had to put up with

if it comes down solely to money and turnover then broncos and storm would win every year as their turnover is around $50m pa each The dogs and parra have huge backing from their respective leagues clubs but it doesn't do them much good

A coach has to develop a culture and then develop players Barrett has done neither of these two things which is why this team doesn't feel like the Manly culture of previous teams and hasn't done so for the past 3 years

From where I sit it doesn't take extra staff in certain positions to get a team playing as.....a team, or to get them with a winning mindset which leads to a winning culture.

As Tooves said on Controversy Corner, he didn't have all that staffing in place and neither did Des before him. And to go back further I would strongly suggest neither did Bozo, Frank Stanton or Ron Willey. In those days the coach was really a one man band and it really wasn't until the late 80s and early 90s that clubs even started to employ specialist behind the scenes staff. And to use not having all those people in place behind the scenes as an excuse for the team not winning and Barrett's own poor coaching record is a bit on the weak side.

The coach is still the one who devises game plans and has back up game plans. Sure they often have help from the assistant coach, the captain and senior players, but ultimately the choice is the coaches. The coach is also the one who sets the teams playing structures in attack and defence. All of those things have been lacking under Trent Barrett. Our game plans are negative and seem to rely on individual brilliance from players like DCE, Turbo or Walks or inspirational play from those like Jake or Thommo or Marty Taupau.

Ultimately, the buck stops with the coach.

I'd question whether you would be able to contract out of equitable rights available @ the Supreme Court of NSW or relevant jurisdiction?

Hey 40 years an Eagle. Was only pulling you chain my friend! The NRL won't want it anywhere near a court, so some sort of agreement will be made. I personally think it's all about fairness, the fact that each NRL team have access to "third parties" to provide incentives to encourage players to stay or leave is really stupid anyway as it opens the door for rorts. Let say A says to B, would you mind throwing in X for Y either a) what's in it for B, and b) is it fair to clubs that don't have access to the privileged that can do this, and c) more importantly under TPA's my understanding is that it would still revert back to the Manly issue of taking appropriate tests on the TPA being at arms length. So at the end of the day if you or anyone said the clubs don't know about the TPA's I call B#llsh*t.
 
Can't a reporter on the game ask what's the delay...kent..ikin..hughes in controversy corner on fox ? I am assuming Manly have submitted their appeal, so what is the delay if we have no case ? If we have a case then wouldn't that be a story ? Cmon bulldog ritchie and rothtool...start reporting.

They have their reputations on the line, and their outstanding integrity and honesty are put into question, of course they will report on dribble they are told to because they won't get their exclusives to report in the future.
