Securing obvious evidence such as CCTV is a routine duty of the police in a case like this, and absolutely it has to be provided to the defence. Should have happened by now but a delay is far from unusual, why, who knows? DNA evidence on the other hand routinely takes ages to produce. As for the CCTV, the cops have probably just lost it. (Don't laugh, it happened in a case I was in and serious charges were subsequently withdrawn)They the law is an ass .I mean surely his Lawyer has a right to the CCTV footage sooner rather than later. The evidence could be exculpatory i.e a positive for the defense, could it not ?
Maybe my learned friends Sea Eagle Rocks or Ulrion could proffer an opinion ?
The defense rests your honors
I found this for the rules of discovery in the US. Are our laws/timeframe similar @SeaEagleRock8 / @urulion ? So if we are similar, it’s possible the prosecution could hold out on the CCTV footage for up till 6 months.Securing obvious evidence such as CCTV is a routine duty of the police in a case like this, and absolutely it has to be provided to the defence. Discovery or Evidence Gathering:
Each side sends questions to be answered under oath and asks for the production of necessary documents. The parties have 20 to 30 days to answer and produce the documents. The judge can set a time limit on discovery, generally giving the parties 3 to 6 months to complete the process.
Nope. In NSW now there is a set timetable for serious charges. The first court adjournment is for 8 weeks for the brief of evidence to be served by the police. However in my experience it is not uncommon for that not to occur, or certainly for there to be some outstanding material. There is no obvious reason why CCTV shouldn't be served within that time. Nevertheless magistrates give the police further adjournments if they aren't ready. (The accused doesn't need to produce anything or answer any questions) The first 'deadline' really is 6 months from the first court date, by which time the DPP must certify which charges are to going proceed to District Court.found this for the rules of discovery in the US. I heard he is a real lady killer....What charges were you up on?
Voting is interesting majority preferring kust as hooker, levi’s experience surely would have had him in front.
I didn't know that he had become an option until just then....Vote changed!Voting is interesting majority preferring kust as hooker, levi’s experience surely would have had him in front.
The poll should be null and void, do a repollThat may be because Levi was a late inclusion on the poll, and people haven't bothered to change their vote.
Or, they prefer cust.
I'm not sure if you are aware but Damien Cook was a champion beach sprinter. Pretty sure I heard it on the coverage onceThey say Damien Cook is fast for a hooker. But seriously, when Tooves decided to run out of dummy half there was none quicker. Off the mark he was like lightning.
