Manase Fainu's case has been delayed with his future "uncertain" as the coronavirus crisis wreaks havoc on the NSW court system.
Fainu's case was supposed to be back in court on Wednesday, but was handled in closed chambers and adjourned to a later date as the court system attempts to halt the spread of COVID-19.
Jack de Belin's case, which is currently set down for April 8, is also set to be affected, with NSW set to face a backlog of jury trials after it was announced that all new trials would be suspended indefinitely.

"It's an issue that is now encompassing the whole legal profession," Fainu's lawyer Elias Tabchouri said. "The way things are gonna be disposed of is so uncertain at the moment, it seems to be changing on a daily basis."

The Manly hooker, who has been stood down indefinitely by the NRL, is facing multiple charges in relation to the alleged stabbing of a man at a Mormon church dance in October.
He has pleaded not guilty to a number of charges, including wounding with intent to cause grievous bodily harm, recklessly causing grievous bodily harm in company and affray.
"It's unclear as to whether even if he was cleared now, whether or not the game will still be around," Tabchouri said. "It's just turned into madness, the whole system on its head."
Police allege Fainu attacked a 24-year-old man with a knife during a brawl at a Wattle Grove party. Police allege the man was later found with a punctured lung after being stabbed in the back.
Tabchouri said he was adamant on getting Fainu a "positive outcome" from the matters and said the delay was disappointing for Fainu and his future playing career.

"I think Fainu's future is one that is subject to these matters moving forward. Clearly what's happening now with the NRL is an important issue as well," Tabchouri said. "Ultimately our view is, as it always has been, that these matters are bigger than rugby league and clearly his rugby league future."
The NSW Family Court and Federal Circuit Court have been closed after a legal staffer tested positive for coronavirus, with the Federal Court reducing its number of hearings for the next four months.
"It's frustrating for everyone involved," Tabchouri said. "That's just what it is, unfortunately, obviously, these are extraordinary times."
Fainu's case is expected to return to Campbelltown Local Court on May 13.

If he is still at local court a Judge needs to refer it to a District Court (because he's pleading not guilty) so if the May 13 still goes ahead which is unlikely, it would be at least 2 weeks to get to the district court if they are open and no backlog, they then have to have a committal, set a trial date. The lawyers will milk delays or court time unavailability to milk more legal fees from the client. This won't be in face of jury till mid next year.

Roughly correct except for this part, it happens on occasion no doubt but delays in District Court trials aren't caused by lawyers. The delays continue to be a huge issue and were the main reason the entire criminal case management procedure for serious charges was revised only last year. The pandemic has now added another complication causing further delays, its a huge problem. At least he's on bail.
 
With the court system being so slow it is exacerbating the punishment of the 'no fault' stand down law. It will be at least two years before the de Belin matter is decided in court which, to me, is way too severe an impost on the player and his club.
I've never been in favour of the rule, however, if the NRL insists on keeping it then perhaps they should consider reducing its initial impact to, say, 4-6 weeks immediate stand down after which the player is allowed to play if he/she is on bail.
Obviously if the player is found guilty by the courts then the NRL can impose their own sentence. At least by then the facts would have been aired in court and the accused given a chance to defend the charges.

Police allege a number of witnesses saw troubled NRL star Manase Fainu with a knife at a Mormon dance party, where he is accused by police of stabbing someone.
The matter involving the 21-year-old Sea Eagles hooker, who denies any wrongdoing, was mentioned electronically in Campbelltown Local Court on Wednesday with a charge certificate filed by the Director of Public Prosecutions.
Police allege three witnesses saw Fainu with a 10cm knife during the fight that his alleged victim started by swinging a bat.

The prosecution will proceed with the charge of wound person with intent to cause grievous bodily harm, with two back-up offences of affray and cause reckless grevious bodily harm also filed.

A charge of cause reckless grevious bodily harm in company is to be withdrawn.

Police allege the Guildford man allegedly stabbed a 24-year-old man in the back in Wattle Grove last October.

The Tongan international spent two weeks behind bars on remand before he was granted $10,000 bail, in which he is only allowed to leave his home without his parents to train, or for medical and legal appointments.

His lawyer previously claimed Fainu was the victim of mistaken identity because of his high profile during an all-in brawl between two groups in the dark.

Fainu had earlier pleaded not guilty to the alleged stabbing and is currently stood down by the NRL’s no-fault stand-down policy.

Negotiations between Fainu, his legal team and the Department of Public Prosecutions will take place in coming weeks

The matter will return to court on May 13.
 
There is the real possiblity that he actually did do it. His arms in a sling and is unable to defend himself so picks up a knife as protection??? If he actually did then it would be the biggest waste of talent ive seen in my lifetime. Hopefully there is enough doubt and will be cleared but it is possibly the end of his short career
 
I’ve completely moved on from Fainu for 2020 ....
The only interesting thing I take from that last article is that three witnesses allegedly saw him with a knife. That he might have had a knife is a separate question to whether he was the actual stabber. I’m going to go out on a limb and say that the chances are high that he was not the only one with a knife present given the attendance of persons with alleged affiliations to gangs.
