Because the contracts for 2017 have been signed and are over the cap. Besides, this means no points deduction because they haven't accrued any with an over the cap team - ala Parra's 12 points.

They will cop a wittle baby fine and a stern talking to from Daddy Greenberg, but not actually have to lose competition points which is what should happen.

Edit: well if the article is correct and it was for 2016 then they should lose points, drop out of the 8 for 2016, bring up the 9th placed team and replay the finals series
