Fainu Off Field Drama

And this is exactly the kind of stuff that makes me say there are grey areas - say, for example, this particular young lady was not OK with being filmed, or having risqué content sent via Snapchat - there’s a better than even chance that the majority of Fainu’s peers are actually OK with it, even that he’s engaged in such behaviour with other young women prior to this and not had anyone bat an eyelid. Little wonder people have trouble knowing where the line is.

I know the content found on the phone my sister had used also made my parents want to throttle the male involved. But I can honestly say there was no indication at all that she was ever anything other than a willing participant in the exchanges. Well, with the possible exception of one video where she was asleep - nothing untoward was *done*, but what was said did make me want to punch the misogynistic little bastard in the face.
Makes me somewhat relieved that I had two boys.
Think I would have been too over the top overprotective if I was a girl daddy.
Heck, some would argue that I am too over protective of my baby boys (15 & 17 but dont tell them@:))

That's pretty much what is happening with Fainu. There are a lot on social media, and I might add in here, who are being harsh on the kid without knowing all the facts. Now don't get me wrong, I can understand those feelings especially from people who have daughters around that age or coming up to that age. But the fact is that we don't know yet (and possibly never will know) if the girl in question knew that she was being videoed and it was being shared so to lay the blame squarely with Fainu without knowing the full story is kinda like putting the cart before the horse.

Lets not string the kid up before we know all the facts.

One thing I will say though. I don't agree with allowing him to play if he is going to go with the mental health issues line in court. If he can't stand in a court of law because of that then he shouldn't be mentally fit to play first grade NRL, or even NSW Cup. Its a double standard and all it does is give the view to the public that professional footballers and football clubs think that they are above the law.
 
Once upon a time in the 70’s it was in vogue to wear tight jeans, sans underwear, replaced with a pair of rolled up footy socks. The fad was short lived after an unfortunate incident with the metal fly @:(
I lived that.... cant believe how tight were the jeans I wore.
Glad to say I was spared the torture of the fly... so too are my children@:D
Hate to brag but always wore underwear and never felt the need for a pair of rolled up footy socks (but please don't ask my girlfriends of the time)

I agree with your first point, but I disagree with the second. He’s not claiming (or more correctly, his lawyer isn’t) that he’s mentally unfit to face court, he’s asking for the disposition of the charges to be dealt with under a specific Section of the act that takes conditions such as mental illness into account. It also takes into account cognitive impairments including learning difficulties, so there’s every chance it’s not even ‘mental illness’ as such that they’re claiming as a mitigating factor for sentencing purposes. Say, for example, he’s dyslexic - it would fit the criteria of S.32, and is probably a smart card to play in a case where social media is a factor - it could be as simple as his defence lawyer arguing he didn’t/doesn’t have the capacity to read and understand the terms of service of Snapchat, hence lacked a proper understanding that he shouldn’t have used it to transmit that type of content.

His lawyer could just as easily be requesting discharge under S.10 (which is basically the ‘I’m a cleanskin, please may I walk away with no conviction?’ request), or S.9 (same same but with a good behaviour bond involved). He’s presumably just gone with S.32 as his client has an applicable condition on the list and it’s a little bit more weight than just the ‘pretty please, I promise I’ll be good’ S.9/S.10 option.

Looks to me like the bloke could fit a cricket protector over his manhood . . . which could have saved Fainu from any alleged indiscretion.

Where are the magic symbols? I thought they had magic symbols on them.
