I’m always an “ innocent until proven guilty” type person , as I’ve seen a heap of trumped up charges laid on people only to find they are not guilty at all.

The drive with drug charge is not the same as DUI. There is no need to prove your driving ability was impaired. The cops obviously didn't think he was impaired, but the offence is made out simply by having the substance in your system while driving.

So if you're not impaired why is it an offence to drive with it in your system?

But the likely answer is -
-obviously any drugs can potentially impair your ability to operate machinery (including prescription drugs)
-certain drugs are actually illegal !
-because they are illegal, there isn't the same political clout in the cocaine industry for example as there is in the alcohol industry, which has been able to say 'Aw c'mon, how about we let a little alcohol driving go free, and a bit more go small penalty, etc. We don't want to stop people drinking! Whereas for some reason the coke lobby hasn't been so successful in this argument to date.
