Thanks for the info, as you say some form of justice has at least been done.
 
No Gallop ??!! Perhaps the sustained public campaign against his inconsistent application of sanctions has finally made him cautious of revealling his Todd love in such a public forum. Be interested in his comment on the current Dally M player and real "face of the game" being put on a good behaviour bond and disqualified from driving. I also look forward to Rebecca "DUI" Wilson's balanced reporting on this matter.

Hello All.
By now you would have heard that the DPP won their appeal against the lenient sentence handed down to Carney by Waverly Court for drink driving. Here is how it went, for anyone interested;
Carney appeared in court with three mates, one being his solicitor (Unlike Brett who was surrounded by supporters and players). The DPP barrister outlined the history of this matter, that being of the original sentence imposed by the Magistrate at Waverley of 6 mths suspended prison and 10 months suspension of license.
Strangely later that same day in chambers, she varied the judgement to that of a 10E Bond only. There appeared to be no record of why she made this decision.
This provided the DPP with the grounds of appeal, namely that
1. The Prosecution were not notified of this change
2. The sentence was inadequate given Carney's driving and criminal history.
While Carney sat in court all suited up, some other poor unfortunate sat in the dock in a tee-shirt waiting for his case to be heard. The Judge had an adjournment to read over the original brief and other court documents.
I caught the lift down to the ground floor with Carney and his mates and they sniggered and laughed, appearing in good spirits.
On the return to court, the DPP person outlined the original case stating that Carney had been given the benefit of two prior 10E judgements, and stated his traffic offence record was 'appalling'. Amongst other offences he has two mid-range drink driving offences and an offensive behaviour and malicious damage offence registered, as well as having had imposed a curfew by the Goulburn District Court due to his drinking.
She called for the judge to set a conviction, disqualification and a bond.
Carney was called by his beak to give evidence.
He stated he'd been fined 10 grand by the roosters, was attending a drink driving program, salvation army lifestyle program, sport fitness program, and seeing a counsellor on a regular basis.
Although he described his traffic record as "very dissappointing", he said all the programs were "going good". His brief then talked about the death of his father and other issues that impacted on this unfortunate life,as well as co-operating with the cops and doing good deeds in the community..
The Judge found that the Waverley Magistrates initial sentence of 6mths suspended sentence of a 10 E was unsound. The drink driving was 0.052.
He then imposed an additional 1000 dollar fine, 12 months disqualification to begin today, and a two year bond with the usual conditions.
Todd and his mates slunk out of court. Justice done, although I'd have liked to see this serial offender locked up, or at least attending a trauma ward at a hospital.
No sight of Gallop.


Nothing will be done by Gallop. If you want Carney to get what he deserves from the NRL we will have to sign him. As a Manly player he would get 4 weeks or so and the club would get a $100,000 dollar fine.

Unless Easts start winning games I can't see a reason they'd want to keep him. Everyone knows winning is the sole motivation for having this bloke in the club.

Thanks DSM5, you've still got it, lol.
No jail possible for Low Range, which was the problem with the original penalty, but sadly it may just be a matter of time for Todd, or alternatively the trauma ward. Don't wish either fate on anyone, so I hope he turns it around (will have to be a full 180).

TODD CARNEY has lost his driver's licence for a year after police won an appeal in his drink-driving case.

The Sydney Roosters player pleaded guilty to a low-range drink-driving offence after he was pulled over for a random breath test in Coogee about 7am on February 26.

He was put on a good behaviour bond in April after the court heard details of his alcoholism and ''shocking'' driving record.

Magistrate Jacqueline Milledge warned the 2010 Dally M medallist to not put another foot wrong and said he was within ''a hair's breadth'' of being sent to prison.

But police appealed against the ''lenient'' decision in the Downing Centre Local Court yesterday.

Judge Ron Solomon agreed and banned Carney from driving a car for a year after finding his driving record was ''abysmal'', it was reported.

''[Carney] has in the past been dealt with by the courts in respect of two mid-range [drinking] offences,'' the judge said.

''It appears there has been continuing disobedience by the offender in respect of his driving.''

Carney, who gave evidence, admitted his driving record was disappointing and said he was ''remorseful'' for his actions.

At the hearing in April, the court was told the 24-year-old was trying to turn his life around

The court was told Carney ''fell apart'' when his father died, aged 57, in 2006. He was on P-plates when he returned a blood alcohol level of 0.052 in March. P-plate drivers are not allowed to have any alcohol in their system while driving.

While Carney and his Newcastle opposite Jarrod Mullen were overlooked for the Origin opener next week, the pair will play a pivotal role for their sides this Sunday when they clash at the SFS in their split round 11 fixture.

While the 14th-placed Roosters (two wins, seven losses) could join the Raiders at the bottom of the ladder with another loss, a win would see the ninth-placed Knights (4-5) move into the eight.

Approaching the halfway mark of the 24-game season, just one win separates seven of the bottom nine teams, with three teams (Wests Tigers, Knights and Rabbitohs) on a 4-5 win-loss record and the other four teams (Sharks, Panthers, Eels, Titans) 3-6.
