The nrl decision will be 'interesting'.

As said, the bar is 11 years or any offence against women or children (ie doesn't have to be 11 yrs max).

So will the nrl go 'nope, sorry eels, stood down until it's cleared up, or sweep sweep, play on as [insert reason here]'.

We often go 'back to snake' but didn't manly stand snake down and the nrl go...nope...didn't stand him down long enough?

The Stewart stand down was ostensibly drink-related. Not for the alleged and thoroughly disproven sexual assault claim. Before a week was out, reports had already surfaced that there was no Stewart DNA to be found on his supposed victim. And yet the police continued to pursue him.

What happened to Brett was a travesty, how the NRL didn't get sued for this is mystifying...

Perhaps because the stand down was supposed to be related to alcohol. However I recall Zorba later claiming that Stewart couldn’t drink much anyway because of his diabetes. If that was so, why was it not highlighted earlier? Maybe there were legal reasons.

The club, or should I say the private owners, can take some blame for the whole affair. The attacks through the press on behalf of the Penns against Delmege helped create a toxic atmosphere. The people that should have been overseeing what happened at Manly Wharf (remember Watmough’s altercation with a sponsor?) departed early. Zorba admitted that is what happened in his Manly Daily column.

The incident involving Stewart may never have eventuated, if someone responsible saw that he needed an escort home. Or if the timing of his arrival home didn’t coincide with the girl’s presence outside his accommodation. Ultimately we will never know.

Happy to hear from any solicitors or barristers out there, but trying to sue might open Brett up to civil hearings. Criminal court is 'beyond reasonable doubt' whereas civil courts are on 'balance of probabilities'. We don't know the evidence. After all, maybe he did do it but it just couldn't be proven to the criminal standard.

I have previously posted that no DNA from Brett Stewart was ever found on the alleged victim that could have confirmed her story. That was confirmed publicly no later than the Friday after the alleged incident. I heard it during an afternoon broadcast on AM radio at the time.

Therefore he most certainly DID NOT do what he is alleged to have done.

The girl’s father (a man who already had a criminal record) also admitted the whole thing was a fiction after it was tossed out of court in 2010.

A couple of points.
1. “Absence of Evidence does not mean Evidence of Absence”, an old quote by Dr Carl Sagan, means, in a very simple term, that, if there is lack of evidence of presence of a thing, does not always conclude to the absence of that thing totally. Just because he put his finger up her jutz doesn't mean he left any DNA behind (if it happened that is).
2. There are only two persons who really know what happened. The girl who was the 'victim' and Brett Stewart. The dads opinion means bugger all. From memory he had a pretty poor relationship with his daughter so for all we know he said what he said to spite her. Stranger things have happened.
3. It would be unbelievably efficient of the NSW Police and the NSW Health labs to get DNA, have it tested and analysed within a single week. Doesn't sound quite right.

I don't have any horses in this Brett Stewart race. He was found not guilty in criminal court. But that doesn't mean he didn't do it. Plenty of guilty people out there go free. You might find a good parallel case in what is now happening with Ben Roberts-Smith. He sued for defamation and it's turned out really bad for him.

My point is that suing might actually be a really bad idea for Brett.

It was 14 years ago. I'm sure Brett would like to move on. Let it go.
