Believe it's the grey area called "pre-existing injury".

If the club knew about his current injury prior to signing him on his current deal, he wouldn't be medically retired.

The injury is something new that must have happened post current contract.

That's how I understand it anyway.
That’s correct....so Choc went to Parra in perfect condition and only sustained his knee problem once there.

That's why I said "grey area".

Like in the Choc instance, the doctor working for the insurance company deemed Chocs injury to be pre-existing BUT the NRL doctor said it was a new injury. In the end they settled half way and paid out half his claim yet the Eels were never forced to include half of Chocs wage on their cap.

Where ever the NRL has the ability to control certain outcomes like this....it'll always be a grey area.
If it’s a split decision they should then have to bring in an independent doctor to make the call.

Considering that the NRL's doctor who signed off on it was (is??) actually the ex Manly club doctor who knew full well that Choc had a history of knee injuries, I would say something dodgy from the NRL definitely went on there in their efforts to help get the Worms under the salary cap. And the fact that the QBE appointed specialist refused to agree that it was a "new" injury tends to say that this was absolute BS.

It could be said that it was typical insurance company trying to get out of a payment, and a big one at that. But seriously, we all knew he had pre-existing injuries. The Worms had signed Choc to that ridiculous 4 year contract after Manly were even balking at 2 years knowing that his body was shot (how many Manly fans said that he would be lucky to last 2 of those 4 years?? I know I said it and we were spot on). I think when he got there they realised that they'd duded themselves and when the salary cap rorting was exposed, used his pre-season injury as a quick excuse to get him off the books and them under the cap. If the NRL's doctor had not signed off on the injury, the Worms would have had to lose a lot more players than just Choc and offloading Nathan Peats and given that they are one of the western Sydney teams with a big fan base, the NRL were never going to allow it to happen.

Plus when the insurance company was stating they weren't going pay, Choc happily said he will turn up to pre-season training so the eels would have to pay him.

didn't sound career ending then...!
