Choc's phone seized?

  • We had an issue with background services between march 10th and 15th or there about. This meant the payment services were not linking to automatic upgrades. If you paid for premium membership and are still seeing ads please let me know and the email you used against PayPal and I cam manually verify and upgrade your account.
Customs can search just about anything coming into the country. The question is not were they acting within their rights to search a phone but why they singled out Choc ( if the story is even true). If they had suspicions of illegal activity from information provided from another govt. agency -think ACC- then that would be fine but would Choc still have the same phone he had from2010? unlikely so would they be looking for something newer?

I had a friend who was coming back from the Greek Isles and they searched his phone and found emails that depicted illegal acts and he had to surrender the phone or be charged (with an offense, not have his phone battery charged!).
 
As for why they would seize it, there is software out there commercially available that will let you access the entire contents of the phone and any deleted data that has not yet been overwritten, and to an extent some chunks of data that have only been semi-overwritten.

Both Android and iOS phones are unix based operating systems. Data is deleted but still present until that segment of disk is used again. That is about the easiest way to explain it.

I highly doubt there would be much data left over from 2010 on there however.

ASADA had Customs do it on their behalf . So in essence Customs can do it , the other mob can't .

I'm also reasonably sure ASADA's new powers mean they can compel someone to hand over their phone now anyway, although as this happened a while ago to Choc it probably happened before they had the legislative powers to do so.

Lets say a person had an iPhone 4 in 2010 and they had deleted info such as text text backed their iPhone up on a laptop on iTunes etc and have upgraded to an iPhone5 and downloaded a backup of the iphone4 to set up the new phi e. do you think there is software that could get that info when it has never been on that phone?

And you honestly expect anyone from asada to know all that. Have they shown any signs of any intellect to date?
 
Is so good about all the confidentiality of these investigations....Someone should have a go at ASADA for leaking info

hmm hard to say. If they took an image of the phone as a backup that data may be there, but this is unlikely as a standard backup does not do this, it just backs up existing data.

In the true sense then it's probably not entrapment . Just the possibility that one government arm is pulling another government arm for assistance is a little too big brother for my liking , especially if you take into consideration the reason for the investigation in the first place . And no my eyes aren't being kept open by match sticks .
 
You have no rights in Australia anyway, why does this come as a surprise? They have more rights in Amerikkka.
 
I seized my kids' lunch boxes this morning, then placed them in their schoolbags. Then I seized my keys and locked the door before seizing the letters out of my mailbox. I might go and seize a cuppa in a minute.

Has Aidan Seizer been involved yet?

Just the possibility that one government arm is pulling another government arm for assistance is a little too big brother for my liking , especially if you take into consideration the reason for the investigation in the first place . I understand what your saying, but we do want govt agencies to co-operate. Ultimately these agencies working together should help minimise bad things happening and make it easier to catch bad guys. No doubt it can be abused and the rights of the indivdual can be at times a secondary concern, but to not have them co-operating would be a far bigger risk and cost us, (as tax-payers) a lot more if they had to do everything themselves.

Apparently the machine they plug it into downloads everything that's been on the phone including deleted texts etc

It was only last week that they did the exact same thing to Gallen word by word yet that was not true.

Lets be honest it's 2013 - who still has their phone from 2010 I've been through at least 8 since then, I'd assume a high paid footballer would have been through a few too.
